Terms of Service

This service is for adults only. By creating an account and continuing to use the service you confirm your age and accept these terms in full. If you disagree with any part of them, do not register and do not use the service.

1. Scope of the agreement and acceptance

These terms govern access to and use of the Swaplse service at swaplse.com. They apply between you and the operator of the service and cover every part of the site: generation, your personal collection, the shared gallery, the AI character chat, purchases of coins and plans, and support.

The Acceptable Use Policy and the Refund Policy form part of these terms, and by accepting these terms you accept those as well. Where the documents differ on a specific question, the document dedicated to that question prevails.

You express acceptance by registering an account, by paying, or by any actual use of the service. No separate signature is required.

2. Who may use the service

The service is available only to persons aged 18 or older. If the age of majority in your country of residence or citizenship is higher, you must have reached that higher age. Registration by anyone below that age is prohibited, and such accounts are deleted together with their data once identified.

You are responsible for whether access to adult material is lawful where you are. If such content is restricted or prohibited in your jurisdiction, you must not use the service. The service does not check local rules on your behalf and does not provide legal advice about them.

You may not use the service if your account was previously blocked for a rules violation or if applicable law bars you from using it.

3. Account and account security

Using the service requires an account: an email address, a password, and confirmation of that address. The password is stored as a hash and is not available to the service in readable form. The details you provide at registration must be accurate and current.

One person may hold only one account. Bulk or automated registration, and creating spare accounts to work around limits, restrictions, or a block, are prohibited.

You are responsible for keeping your credentials safe and for everything done under your account, including purchases and publications. Report any suspected unauthorised access to support. You can delete the account yourself in settings, section "Account", or by writing to support from the account email.

4. What the service does and the synthetic nature of the output

The service generates images and short videos from a text description, animates an uploaded frame (image to video), processes material you upload, runs a chat with an AI character, and lets you keep works in a personal collection and publish them to the shared gallery.

All output is produced by a neural network and is synthetic. The characters depicted are fictional and no real performers take part. For that reason the service relies on the record-keeping exemption under 18 U.S.C. 2257.

Generative models are variable: the same request may return different results, and the result you want may not be achievable at all. The service does not promise any particular quality, likeness, style, or content for an individual generation.

5. Coins, plans, and payment

Coins are the internal accounting unit of the service. The cost of each action in coins is shown on the creation page before you start it. Coins are not a means of payment, have no value outside the service, cannot be transferred between accounts, and are not exchanged back into money except as described in the Refund Policy.

Purchases are one-off: coin packs and fixed-period plans (Lite, Plus, Ultimate; periods of 1, 3, and 12 months). There are no automatic charges and no self-renewing subscription: when a paid period ends nothing is charged and renewal has to be arranged separately. Unused coins do not expire while the account exists.

Payment is made in cryptocurrency against an issued invoice. The service does not accept or store bank card details. If a payment went through but coins were not credited, contact support with the transaction hash and the credit will be applied manually. Refund conditions, including a technical failure during generation, are set out in the Refund Policy.

6. Your material and the licence you grant

Material you upload or enter (photos, videos, prompt text, chat messages) remains yours. You are responsible for having the right to upload and process it.

By uploading an image of a person you confirm that it depicts you, or an adult who gave explicit consent to such processing. Uploading images of third parties without consent is prohibited, public figures included.

You grant the service a non-exclusive, royalty-free licence to store, reproduce, and technically process your material to the extent needed to provide the service: running the generation, including on the infrastructure of a third-party GPU provider, showing you the result, keeping the work in your collection, and moderation. By publishing a work to the shared gallery you additionally allow it to be shown to other users within the service. This licence ends when you delete the material or the account, except for copies that have to be retained by law or to handle a violation.

7. Rights in the generations you create

Rights in the results you create belong to you to the extent permitted by applicable law. The service claims no rights of its own in your generations and takes no royalty for their use.

Note that in a number of jurisdictions output created without human creative input may not attract copyright at all. The service does not guarantee that a result is protectable, nor that a similar result will not be produced by another user: generative models can return close images for close requests.

You are responsible for further use, publication, and distribution of a result outside the service, including compliance with the rules of the platforms where you post it and the duty not to present synthetic material as a genuine recording of a real person.

8. Prohibited use

It is prohibited to create, upload, store, or publish, among other things:

Actions directed at the service itself are prohibited as well: malicious code, circumventing technical protection measures and limits, automated data collection, reverse engineering, and reselling access without written permission.

This list is abridged. The full set of prohibitions, the moderation procedure, and the consequences of a violation are set out in the Acceptable Use Policy.

9. Moderation, suspension, and blocking

Uploads and publications are reviewed by automated systems and by hand. The service may refuse a request, unpublish a work, restrict access to individual features, and suspend or block an account for a breach of these terms, of the Acceptable Use Policy, or of applicable law.

Substantiated complaints are handled within 72 hours: the content is taken down, and repeat violations lead to the account being blocked. Material involving minors is removed immediately and reported to the competent authorities. The author of a removed work may submit a counter-notice; the content stays down until the dispute is resolved.

If an account is blocked for a rules violation, the remaining coin balance is not refunded. Suspension or blocking does not release you from liability for violations already committed.

10. The service's intellectual property

The site, its interface, software code, the Swaplse name and logo, design, page text, prompt collections, and other elements of the service belong to the operator or are used by it on a lawful basis and are protected by applicable law.

These terms transfer no rights in the elements of the service to you beyond the right to use it for its intended purpose while your account exists. Copying the interface, extracting service data, building derivative products on its basis, and using the name and logo without written permission are prohibited.

11. Disclaimer of warranties

The service is provided "as is" and "as available". To the extent permitted by applicable law, the service gives no express or implied warranties, including warranties of fitness for a particular purpose, of meeting your expectations, or of non-infringement of third-party rights.

There is no guarantee of uninterrupted or error-free operation, of availability at any given moment, of the survival of results in the event of an infrastructure failure, or of any particular generation result. Works that matter to you should be saved on your own side.

Planned and unplanned interruptions are possible during updates, maintenance, and incidents at hosting and compute providers.

12. Limitation of liability

To the extent permitted by applicable law, the service is not liable for indirect damages: lost profit, loss of data, loss of goodwill or anticipated savings, or losses caused by the use of generated results outside the service.

The service's aggregate liability for all claims connected with use of the service is limited to the greater of two amounts: the sum you actually paid to the service over the last 12 months, or 100 euro.

These limits do not apply to the extent liability cannot be limited under applicable law, and they do not affect mandatory consumer rights.

13. Indemnification by the user

You undertake to compensate the service for documented losses, including reasonable legal costs, where they arise from your material, from your breach of these terms or of the Acceptable Use Policy, from your infringement of third-party rights, or from your unlawful use of generated results.

The service will notify you of such a claim and may conduct the defence itself. No claim is admitted on your behalf without your consent.

14. Termination and its consequences

You may stop using the service at any time by deleting the account in settings or by writing to support from the account email. Deleting the account removes the account, the works, and the remaining coin balance; payment records are kept for as long as applicable accounting and tax law requires.

The service may end or restrict access for a breach of these terms, or where the service is discontinued. If access ends on the service's initiative through no fault of yours, unused coins are dealt with under the Refund Policy; where an account is blocked for a violation they are not refunded.

The sections on intellectual property, disclaimer of warranties, limitation of liability, indemnification, and dispute resolution survive termination of access.

15. Changes to these terms

The service may update these terms when features change, when payment mechanics change, or when the law requires it. The current version is always published on this page and the update date is shown at the top.

Material changes are announced in the service interface or by an email to the account address. Continued use of the service after the changes take effect means you accept the new version. If you disagree, stop using the service and delete your account.

16. Governing law and dispute resolution

These terms are governed by the law applicable to the operation of the service, subject to the mandatory rules of your country of habitual residence where you act as a consumer. These terms do not deprive you of rights that cannot be limited by agreement.

Before going to court the parties undertake to use a complaint procedure: send a description of your claim to support from the account email, stating the subject in the email header. A claim is reviewed within 30 days of receipt. Most questions are settled at this stage.

If a dispute cannot be settled that way, it is heard by the competent court under the applicable procedural law.

17. Contact

The only contact address is support@swaplse.com. The support form on the site also works, and every work page has a "Report" button.

To route your message faster, state the subject in the email header: "DMCA", "Privacy", "Refund", "Account deletion". Requests concerning an account are accepted from the email address of that account.
